1. Introduction

Welcome to SellMyTickets Pty Ltd (ABN 92 359 122 896), trading as SellMyTickets (“SellMyTickets”, “we”, “us”, or “our”). SellMyTickets operates the online ticketing platform located at www.sellmytickets.com.au (the “Site”), which enables event organisers, promoters, venues, and authorised ticket sellers (“Hosts”) to list, market, and sell tickets for events, and allows consumers (“Attendees”) to purchase tickets for those events, including approved resale tickets where available.

By accessing or using the Site, creating an account, listing an event, purchasing tickets, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, together with our Privacy Policy, Cookie Policy, Community Guidelines, Host Agreement, Refund Policy, and any other policies published on the Site.

2. Nature of Our Services

SellMyTickets provides a technology platform that facilitates ticket sales and related services.

For Primary Ticket Sales, SellMyTickets acts solely as an agent on behalf of the Host. The contract for attendance at the event is formed directly between the Attendee and the Host, and the Host is responsible for the delivery and operation of the event.

For Resale Ticket Transactions, SellMyTickets operates as a marketplace that facilitates transactions between approved ticket sellers (“Resale Sellers”) and purchasers (“Buyers”). Upon completion of a resale transaction, a separate contract is formed directly between the Resale Seller and the Buyer.

3. Eligibility and Account Security

To use our services, you must be at least eighteen (18) years of age and legally capable of entering into binding contracts under applicable law. By creating an account, you warrant that all information provided is accurate, complete, and up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. SellMyTickets reserves the right to require identity verification and additional security checks at any time to protect users and prevent fraudulent activity.

4. Ticket Types and Listing Requirements

Tickets available through the Site may include Primary Tickets and Resale Tickets.

Primary Tickets are listed directly by Hosts and are subject to any specific conditions imposed by the Host or venue. Resale Tickets may only be listed where permitted by the Host and applicable law and must generally have been originally purchased through the SellMyTickets platform unless otherwise approved by us.

SellMyTickets reserves the right to refuse, suspend, or remove any ticket listing that breaches these Terms, applicable legislation, venue policies, or our platform rules.

5. Pricing, Fees, and Taxes

All ticket prices displayed on the Site are shown in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable, unless expressly stated otherwise.

A Service Fee may apply to ticket purchases. The Service Fee is currently 2.5% for commercial events and 2.0% for approved registered not-for-profit events, plus GST, unless otherwise agreed in writing by SellMyTickets.

A payment surcharge may also apply and may vary depending on the payment method selected by the purchaser.

Additional fees, taxes, levies, payment processing charges, government charges, or regulatory fees may apply and will be disclosed where required by law.

SellMyTickets reserves the right to amend its fees, charges, service fees, and surcharges from time to time. Any changes will apply only to future transactions and will be displayed on the Site or communicated to Hosts where applicable.

6. Order Limits and Verification

SellMyTickets may impose limits on ticket purchases per transaction, account, or event. Orders exceeding those limits may be cancelled without notice.

To prevent fraud and unauthorised purchasing, we may conduct verification checks before processing transactions. We reserve the right to delay, refuse, or cancel any order that cannot be satisfactorily verified.

7. Ticket Delivery

Unless otherwise specified, tickets will be delivered electronically as digital eTickets. Delivery timing may vary depending on event settings, verification requirements, or Host instructions.

It is the purchaser’s responsibility to ensure that accurate contact details are provided.

8. Cancellations, Postponements, and Refunds

Nothing in these Terms excludes, restricts, or modifies any rights available under the Australian Consumer Law (ACL).

Where an event is cancelled, refunds will generally be provided in accordance with the Host’s refund policy and applicable law.

Where an event is postponed or rescheduled, tickets will generally remain valid for the new date unless otherwise required by law or determined by the Host.

9. Exchanges, Transfers, and Resales

Tickets may only be exchanged, transferred, or resold where expressly permitted by the Host and through authorised SellMyTickets processes.

Unauthorised resale, transfer, or commercial exploitation may result in cancellation without refund.

10. Venue Conditions, Admission, and Conduct

Attendance at events is subject to venue rules, event conditions, health and safety requirements, and instructions issued by event staff.

Hosts and venue operators may refuse admission or remove any person whose conduct is unsafe, disruptive, unlawful, offensive, or inconsistent with venue policies.

11. Errors and Availability

SellMyTickets endeavours to ensure that information displayed on the Site is accurate. However, errors relating to pricing, availability, event details, or descriptions may occur.

We reserve the right to correct errors, amend information, cancel affected orders, and provide appropriate remedies.

12. Chargebacks and Payment Disputes

Users must not initiate chargebacks through SellMyTickets, and reach out to the event organisor directly.

13. Intellectual Property and Acceptable Use

All content, trademarks, logos, software, text, graphics, and materials available on the Site are owned by or licensed to SellMyTickets and are protected by applicable intellectual property laws.

Users are granted a limited, revocable licence to access and use the Site for lawful purposes only.

14. Privacy and Data Handling

SellMyTickets collects, stores, uses, and discloses personal information in accordance with its Privacy Policy and applicable privacy legislation.

15. Warranties and Limitation of Liability

To the maximum extent permitted by law, SellMyTickets does not guarantee uninterrupted or error-free operation of the Site.

Liability is limited to the maximum extent permitted by law.

16. Indemnity

Users agree to indemnify and hold harmless SellMyTickets, its directors, officers, employees, contractors, affiliates, and agents against claims, losses, damages, liabilities, costs, and expenses arising from misuse of the Site or breach of these Terms.

17. Suspension, Termination, and Amendments

SellMyTickets may suspend, restrict, or terminate accounts where these Terms are breached or where necessary to protect the integrity of the platform.

We may amend these Terms at any time by publishing updated versions on the Site.

18. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

20. Host Responsibilities

Hosts are solely responsible for obtaining all permits, licences, approvals, insurance, and regulatory requirements necessary to conduct their events and must comply with all applicable laws.

21. Host Payouts and Settlement

SellMyTickets may release event proceeds after the event concludes and reserves the right to withhold payouts where fraud investigations, chargebacks, disputes, or compliance reviews are ongoing.

22. Force Majeure

SellMyTickets shall not be liable for delays, interruptions, cancellations, or failures caused by events beyond reasonable control, including natural disasters, pandemics, cyber incidents, internet outages, government actions, industrial disputes, or acts of terrorism.

23. Fraud Prevention and Anti-Scalping

The use of automated purchasing software, bots, unauthorised resale methods, or ticket scalping practices prohibited by law is strictly prohibited.

24. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies available under the Competition and Consumer Act 2010 (Cth) and Australian Consumer Law.

25. Electronic Communications

Users consent to receiving notices, disclosures, agreements, and communications electronically.

26. GST and Tax Invoices

GST will be applied where required by law. Tax invoices will be provided where applicable. Hosts remain responsible for their own taxation obligations.

27. Dispute Resolution

Parties agree to attempt to resolve disputes through good-faith negotiations before commencing legal proceedings. Where appropriate, disputes may be referred to mediation in New South Wales.

28. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

29. Entire Agreement

These Terms and Conditions, together with the Privacy Policy, Cookie Policy, Refund Policy, Host Agreement, and any other policies published by SellMyTickets, constitute the entire agreement between the parties regarding use of the platform.

By accessing or using the SellMyTickets platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
